6 Data Retention

When your account is deleted, we will remove your personal data within 30 days, except where we are required to retain it by law.

Terms of Service
Rules and conditions governing your use of Estate Web
⚠ Critical Fraud Warning — Nigeria-Specific
Estate Web is a LISTING PLATFORM ONLY. We do NOT:
- Own, verify, or guarantee any property
- Confirm land titles or conduct title searches
- Act as real estate agents, brokers, or legal advisers
- Handle payments, escrow, or money transfers
- Protect against 'Omo Onile' disputes, government acquisition, or fraudulent sellers
YOU MUST:
- Verify land titles at the Land Registry (e.g., Alausa for Lagos State)
- Conduct physical property inspections before any payment
- Hire a lawyer to review all property documents
- Confirm the identity of sellers/agents through government-issued ID
- NEVER pay 'inspection fees', 'processing fees', or deposits without verified legal documentation
1 Acceptance of Terms
By creating an account, listing properties, or using any service on Estate Web, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using our Platform on behalf of a company or entity, you represent that you have authority to bind that entity.
2 User Accounts & Registration
2.1 Eligibility
You must be at least 18 years old to use Estate Web. By registering, you confirm that all information provided is accurate and complete.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify us of any unauthorised access. You are liable for all activities under your account.
2.3 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose security risks.
3 Property Listings & Content
3.1 Listing Requirements
All property listings must:
- Be accurate, truthful, and not misleading
- Contain genuine property information and recent, unaltered images
- Comply with Nigerian property and advertising laws
- Not infringe on third-party intellectual property rights
- Include valid contact information for enquiries
- Represent properties that are actually available for sale, rent, or lease
- Be updated or removed within 48 hours if the property is sold, rented, or no longer available
3.2 Prohibited Listings
You may NOT list:
- Properties you do not own or have authorisation to list
- Fake, duplicate, or fraudulent properties
- 'Stale' listings — properties already sold, rented, or no longer available
- Properties with disputed ownership, pending litigation, or 'Omo Onile' conflicts
- Properties under government acquisition or with unresolved title issues
- Content containing hate speech, violence, or promotion of illegal activities
- Properties that violate zoning or land use regulations
- Images or descriptions copied from other websites without permission
3.3 Content Ownership & Licence
You retain ownership of content you upload. By posting on Estate Web, you grant us a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute your content for operating and promoting our Platform.
3.4 Content Removal
We reserve the right to remove, edit, or refuse any listing or content that violates these Terms, without prior notice or liability.
4 User Conduct & Prohibited Activities
You agree NOT to:
- Impersonate others or provide false information
- Use the Platform for fraudulent, illegal, or unauthorised purposes
- Scrape, harvest, or collect user data without permission
- Interfere with or disrupt Platform security or functionality
- Upload viruses, malware, or malicious code
- Harass, abuse, or threaten other users
- Attempt to bypass any security or access control measures
- Use automated tools (bots, scripts) without authorisation
- Manipulate property prices or engage in price-fixing
- Solicit personal information from minors
5 Transactions & Payments
5.1 Third-Party Transactions
Estate Web is a listing platform. All property transactions occur directly between buyers/tenants and sellers/agents. We are not a party to these transactions and assume no responsibility for their completion, payment disputes, property condition, or legal compliance.
5.2 Platform Fees
We may charge fees for premium listings, featured placements, or subscriptions. All fees are non-refundable unless explicitly stated. Prices are subject to change with 30 days' notice.
5.3 Payment Processing
Payments are processed through third-party providers (Paystack, Flutterwave). We do not store your full payment card details. You agree to the payment processor's terms.
6 Disclaimers & Limitations of Liability
The Platform is provided "as is" without warranties of any kind. We do not guarantee accuracy, completeness, or reliability of listings, uninterrupted service, or the success of any transaction.
6.2 Verification Disclaimer
Verification services are LIMITED to confirming that an ID document appears genuine and that submitted documents are readable. Verification does not mean we confirm legal ownership, conduct title searches, or guarantee authority to sell or lease.
Verification reduces risk but does not replace your own due diligence. You must still verify everything independently with lawyers and at the Land Registry.
6.3 Third-Party Content
We are not responsible for content, actions, or omissions of third-party users, agents, or external websites linked from our Platform.
6.4 Limitation of Liability
To the maximum extent permitted by Nigerian law, Estate Web shall not be liable for financial losses from property transactions, fraud or disputes between users, property defects or title issues, data loss or security breaches, or indirect, consequential, or punitive damages.
Our total liability for any claim shall not exceed the fees you paid us in the 12 months preceding the claim, or ₦50,000, whichever is lower.
7 Indemnification
You agree to indemnify, defend, and hold harmless Estate Web, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your property listings or content
- Your transactions with other users
- Your violation of any law or third-party rights
8 Intellectual Property
All Platform content, design, logos, trademarks, and software are owned by Estate Web or licensed to us. You may not copy, reproduce, distribute, or create derivative works without written permission.
9 Dispute Resolution & Arbitration
9.1 Informal Resolution
Before initiating legal action, you agree to contact us at contact@estatewebng.com to seek informal resolution.
9.2 Arbitration Agreement
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration under the Arbitration and Conciliation Act (Nigeria), rather than in court. Arbitration shall be conducted in Lagos, Nigeria, in English.
9.3 Exceptions
Either party may seek injunctive relief in court for intellectual property violations or urgent matters.
10 Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Nigeria. Any legal action not subject to arbitration shall be brought exclusively in the courts of Lagos State, Nigeria.
11 Changes to Terms & Privacy Policy
We may update these Terms and Privacy Policy at any time. Material changes will be notified via email or Platform notice. Continued use after changes constitutes acceptance. If you disagree, you must stop using the Platform.
12 Termination
We may terminate or suspend your access immediately, without notice, for conduct violating these Terms or harmful to other users, us, or third parties. Upon termination, your right to use the Platform ceases.
13 Miscellaneous
Severability
If any provision is invalid, the remaining provisions remain in effect.
Waiver
Our failure to enforce any right does not waive that right.
Assignment
You may not assign these Terms. We may assign them without restriction.
Entire Agreement
These Terms constitute the entire agreement between you and Estate Web.
Force Majeure
We are not liable for delays or failures due to events beyond our control.
